The case involves the intestate estate of Martha Stubblefield Bernard, represented by its administrator, Ebrima Varney Dempster, as the plaintiff/appellee, versus the intestate estate of the late William Thomas Bernard, represented by Archibald F. Bernard and others, along with the Congress for Democratic Change (CDC), represented by  Acting Chairman, Attorney Janga Kowo, as the defendants/appellants.

The court’s order, dated March 7, 2024, commands the Sheriff of Montserrado County to place the plaintiff/appellee, Ebrima Varney Dempster, in full possession of a contested property located at the intersection of Tubman Boulevard and the road leading to Bernard’s Beach. The property, as specified in the deed, measures 4.23 acres and is described in detailed metes and bounds in the court’s writ.

The order follows a final judgment delivered on May 15, 2015, by former Judge Johannes Zogbay Zlahn. The writ of possession requires the eviction of the defendants/appellants from the property and mandates that the sheriff execute this order promptly.

The ruling underscores the judiciary’s role in resolving complex estate and property disputes, ensuring the enforcement of legal judgments and the protection of property rights.

The court has instructed the sheriff to provide official returns on the writ of possession, documenting the service and execution of the order.

This development marks a significant moment in the ongoing legal proceedings related to the Bernard family estates and the Congress for Democratic Change, reflecting the judiciary’s commitment to upholding property laws and resolving disputes equitably.
